These General Terms and Conditions constitute a binding legal agreement between you (the "User") and Fondsdam. By accessing the services or registering an account on https://fondsdam-ai.org, you acknowledge that you have fully read, understood, and agree to be bound by these terms.

1. Access and Account Security

The use of the Fondsdam infrastructure is strictly reserved for individuals aged 18 or older who are fully legally competent under Belgian law. As a User, you are solely responsible for keeping your login credentials and multi-factor authentication (MFA) codes confidential.

2. Nature of Services (Execution-Only)

Fondsdam is an advanced technical interface that provides users with rapid market data aggregation and analytical quantitative tools.

No financial advice: We exclusively function as a technology and software provider. Our data streams and AI tools should never be interpreted as financial, investment, tax, or legal advice. Fondsdam does not act as an FSMA-regulated broker.
User autonomy: Every transaction or decision executed on the market based on our platform data is made entirely independently, at the User's own risk and discretion.
Statutory Risk Warning: Participation in the trading of digital assets and complex global financial instruments carries an exceptionally high risk of substantial capital loss. Historical data models and predictive algorithms offer no guarantee whatsoever for future market performance or profitability. Only use risk capital that is not essential for your fundamental financial livelihood.

3. Integrity and Prohibited Use

Any violation of the following security protocols will lead to immediate, permanent account termination and possible escalation to the competent Belgian authorities:

Misusing the platform for money laundering, financing illegal practices, or tax evasion.
Deploying unauthorized scraping bots or attempting to reverse-engineer our patented algorithms.
Coordinated activities aimed at disrupting server load (such as DDoS) or bypassing platform security.

4. Limitation of Liability

To the maximum extent permitted under Belgian law, Fondsdam, its directors, and technical partners are not liable for direct, indirect, or consequential damages — including significant capital loss or data corruption — arising from API delays, technical malfunctions of liquidity providers, or extreme volatility in the crypto markets.

5. Applicable Law and Jurisdiction

This user agreement is governed by and interpreted in absolute accordance with Belgian law. All disputes or claims arising from the use of the platform and that cannot be resolved through internal mediation fall under the exclusive jurisdiction of the competent courts of the judicial district of Brussels.
